Kimberly Smith had a(nother) court date today in her Case No. 11CF000521. It was a quick one, because Judge Prather's cases were heard this morning by Judge Graham. To me, that meant an automatic continuance.
After her husband's conviction (Timothy Smith, Case No. 11CF000520) on February 28, Kim had a trial date of March 11 (today). In the meantime a court date got scheduled on March 1. On that date there was a 402 Conference, and her trial date March 11 (today) was stricken. That likely means a deal has been reached and, indeed, one was expected as a result of the subpoena issued that virtually forced her to testify in her husband's trial.
A new court date was set. Because of low tones of voice at the bench today, I could not hear the date, but I believe it is in about two weeks.
Kimberly was granted use immunity and nothing to which she testified in her husband's trial can be used against her. This probably leaves the prosecution pretty dry of evidence, and we'll find out in a couple of weeks what the deal is.
