Student missed 18/20; gets a Smiley face

Be sure to watch this TED production. It's only seven minutes, and your life will be better for it. Just imagine if our schools were full of teachers like this woman!

Then show up at School Board meetings and insist that your school district hire (and keep) only teachers with this philosophy. Dump the rest. OK, give 'em a chance to change. Maybe one year to improve their attitudes. If they don't (tenure or not), kick them out.

Sheriff's race - really?

Is there really an important election for McHenry County Sheriff coming up? Where is all the news from and about the two candidates, Jim Harrison and Bill Prim?

Is anybody talking about the race? Will there be debates (not just wimpy "forums")? What are the issues?

Election Day is Tuesday, November 4. That's two months from now.

One issue that I'd like to hear debated is the failed (in my opinion) investigation of the triple homicide that occurred in McHenry County, outside Marengo, on June 7, 2011. Three people died that night - Jack Feldkamp, Audrey Feldkamp and Doran Bloom.

The case was "solved" in less than 24 hours, according to now-retiring Sheriff Keith Nygren. He held a news conference (excluding electronic news hounds Cal Skinner, Pete Gonigam and yours truly) less than 24 hours later. Nygren had the gall to post a notice in the hallway at the courthouse that only "credentialed media" would be admitted to the press conference.

Nygren, prior to any meaningful, thorough investigation and without even the benefit of a written statement from Scott Feldkamp, son of the deceased Jack and Audrey Feldkamp, drew a conclusion and announced, in effect, "Case closed." After that, deputies wrote up reports and that was that. You can understand that no deputy would ask a career-ending question, like "What if Doran Bloom didn't do it?"

MIAT (a County-wide Major Investigations Assistance Team) was never activated. Undersheriff Zinke was the lead cop over MIAT. Only deputies of the McHenry County Sheriff's Department "investigated". Independent, trained eyes from other local police agencies were never called in. Reports do not indicate that any blood samples or clothing were ever sent to a laboratory for testing.

I've been told by more than one experienced crime-scene investigator that this case was mishandled worse than any case they had ever seen. The crime scene log shows that Nygren and Zinke were there for only 15 minutes that night, and there is lingering doubt in my mind that Nygren was even in town that night, because I was told the next day that Nygren had returned to McHenry County on the morning of June 8 to hold the press conference. 

The squatter is out of the Feldkamp family home now. He had nothing to do with the homicide, but a reasonable question would be why he was allowed to live in the house for a long time, possibly rent-free. The house was an asset of the estate.

The Estates of Jack and Audry Feldkamp are now scheduled for closing on November 13th. No doubt that Woodstock Attorney Carl Gilmore will be delighted if Judge Chmiel approves closing of the estates.

So the question is, will Prim or Harrison re-open this case and investigate it the way it should have been investigated in June 2011?

Struggle to get records from MCSD

On July 13, 2014, I filed a FOIA request with the McHenry County Sheriff's Department for the reports in the domestic violence call involving Deputy Jennifer Asplund.

When no response was forthcoming, I filed a Request for Review with the Attorney General's Public Access Bureau (PAB). When the PAB contacted MCSD, it was told that MCSD had never received my request.

But the County I.T. Department did receive it, and they could have cleansed the email of any "threat" it contained and forwarded it to MCSD. Instead, they quarantined it and then purged it.

How strange, to me, that this one email from me would contain what they referred to as a "serious threat" (to the email system).

So I re-submitted my request by email, with copies to Undersheriff Zinke, Cmdr. Cedergren and the I.T. guy, asking them to confirm receipt by the FOIA Officer and to let me know that MCSD had received it. Do you think that one of them could have had the courtesy to send me a short email? Not one of them did.

I had to telephone the MCSD Records Division, where an employee told me that my re-submitted email had been received.  I'm not really sure that MCSD knows who its FOIA Officer is. Is it Duane Cedergren? Sgt. Decman? Somebody else? The employee didn't seem to know.

When Mrs. Weech was the FOIA Officer, everybody knew it. No employees pretended to be "the" FOIA officer or "one of them". There is only one. That "one" may have assistants, but there is only one FOIA Officer.

When MCSD responded, it sent me an embarrassing example of a FOIA response, which prompted a request to the PAB for further review. Lines and lines of the reports were redacted. Not just a few words or a few lines. So many lines were redacted that you can't tell what happened.

So the PAB will take another shot at MCSD, and I suspect an Assistant Attorney General will tell MCSD to provide the narrative reports almost in full. Certain limited data can be redacted, but not wholesale blocks of the report.

So, stand by. In the meantime, I may figure out how to publish .pdf pages and show you how MCSD handled this request. Or maybe I'll wait for the PAB to do its magic, and then I'll show you the before and after versions of the response.

Domestic violence - when to arrest?

Two months ago, on Saturday, June 21, just before 4:30am, an incident of domestic violence occurred in McHenry County. The McHenry County Sheriff's Department (MCSD) was contacted and responded.

A suspect was quickly identified. The suspect was well-known to deputies of the McHenry County Sheriff's Department. While the first deputy was enroute to a residence on Barnard Mill Road on an "unwanted person" call, he was advised (presumably by police radio, although the report doesn't say; maybe he was called on his cell phone, so that the communication would not be recorded) that the (unwanted) person had left and was intoxicated. Upon arrival, a male victim informed the first deputy that he was a victim of a domestic battery.

The suspect was a female deputy of the Sheriff's Department.

After speaking with the victim and observing his injuries, the deputy summoned his supervisor. The supervisor and the deputy interviewed the victim.

The supervisor's report of the victim's explanation is completely redacted in the FOIA response from MCSD. Not just a few words here and there. Not just the limited information that can be lawfully redacted under exemptions in the Illinois Freedom of Information Act. About 20 entire lines of the report are redacted on the first page of the report (and more redactions later in the report).

The supervisor's report then continues that the deputy photographed the victim's injuries and got first names of two bartenders at the Rusty Nail (4520 Ringwood Rd., Ringwood, Ill.).

I would like to thank "Sloth Chunk", who recently commented on a previous article about this incident. In his comment, "Sloth Chunk" wrote, "And a domestic dispute is just that, a dispute. A domestic assault is different and has mandatory arrest laws. That is if there is Probable Cause that a battery occurred."

So, if a victim says he was battered and has visible injuries that can be photographed, is there P.C.?

The report of the supervisor was carefully titled "Domestic Dispute", even though it lists "personal weapons (hands, fist, feet)" and refers to injuries to the victim, photographs of those injuries and the victim's statement that he "...was also a victim of a domestic battery." (This will be important later, when the State's Attorney's Office refuses to file felony charges (and the Department chooses not to file misdemeanor charges.))

What do Ferguson rioters want?

What do the rioters in Ferguson, Mo. want? Justice?

No, they want a lynching. They want to give Officer Darren Wilson a fair trial and string him up. Preferably, by sundown today.

The talking heads, from newscasters, reporters, videographers, politicians, bureaucrats, are inflaming the protestors and rioters.

Has even one of them seriously asked important questions? And told the protestors to calm down and figure out what looting and rioting are doing to find the answers?

They demand indictment of Wilson. If he is not indicted, the rioting and protests will intensify. It's "Don't confuse me with the facts. My mind is made up."

Like anyone else, I want to know why Officer Wilson shot Michael Brown. And I don't think I'm going to find out, short of a trial. If he went in front of cameras and made a statement, who would believe him if he said that Brown was rushing him and that he was in fear of great bodily harm.

Hadn't he already been punched in the face by Brown? Hadn't Brown already tried to get the officer's firearm away from him? Yes or no?

If a 6'4" man punched you in the face through the open window of your car, might you be afraid?

Mo. S/P Capt. Johnson lies to press

Supposedly Capt. Ronald S. Johnson of the Missouri State Highway Patrol said at a press conference at 2:30am “Our officers came under heavy fire.”

Anyone believe that?

I have no doubt that troopers, officers, deputies and National Guardsmen are exposed to dangerous and life-threatening conditions. Most police officers never encounter these conditions during their entire careers. Those in a war zone in a city might, but not like what is going on in Ferguson. Military with combat duty know what it feels like to those on the ground in Ferguson.

But "came under heavy fire"? If they had, there would be injured and dead law-enforcement personnel and they would have fired back.

These are not peaceful demonstrations in Ferguson!

What if police and preachers and social workers circulated today and told demonstrators that tonight the police presence would be nearly invisible. What if they said, "Prove to us that the absence of police will mean peace." And "we'll be ready to return immediately, if there are threats to people, rioting or looting."

Right now this is a situation where "militarized" police are needed. Obama should keep his mouth shut. Holder should stay in Washington. Gov. Nixon should get back to Jefferson City, if he happens to be a governor who actually lives in the capital city of the state. Let people who know what they are doing, handle this.

Identify and grab the rabblerousers and those who are inciting riots. Do police really have a plan for restoring peace in Ferguson? Will it become another Watts?

Get the residents to understand that they really don't know exactly what happened in the street that day. One person knows - Officer Wilson.

Dorian Johnson, Brown's partner in the strong-arm robbery at the convenience store, has already been proven a liar and an untrustworthy "eyewitness." Didn't he say Brown was shot in the back? It makes a good story (for Brown), but the family's own autopsy reveals Brown was shot from the front - only. No entry wounds in the back.

Well before now, there should have been a re-enactment. Has there been? Obviously, they can't do it at the scene. Have they staged it elsewhere?

Holder to Ferguson

Cannot anyone control Obama? He is going to send Eric Holder to Ferguson, Mo.

Good. Send Holder in jeans and a hoodie. No ID. No money. No bodyguards. Tell him to scream at the cops. Tell him to violate police orders to clear the area.Tell him to ignore the curfew, if there is one.

Lock his butt up. Throw away the key. Better yet, send him to southern Arizona and stick him out on one of the trails used by the mules.

Missouri Gov. Nixon is making a worse mess in Ferguson, ordering out the National Guard to protect the police command center. Is he so stupid that he thinks that is what is causing the continued riots?

Here's a suggestion for Gov. Nixon: remove the van. Remove the National Guard. Remove the State Police. You think they are the problem? Then see what's left of Ferguson in the morning.

Who knows? Maybe all the protestors will just go home and sleep it off.

Disbar Attorneys Crump and Parks

Stay back, everyone. You don't want to get run over by the ambulances....

Attorneys Crump and Parks, in the Michael Brown case, should be disbarred. Using words like execution and murder ought to land them behind bars. Stating that the autopsy is performed by the law enforcement groups that killed Brown is a lie and serves only to agitate people further. Baloney!

They are misreporting the autopsy results and the involvement of the Federal Government. Will  someone explain just why the Feds are involved in the Ferguson, Mo. mess? Why a third autopsy?

That clown that did the autopsy for the family? Look at the diagram. Where is the shot to the back that Dorian Johnson said caused Brown to stop running and turn around? Johnson is a liar, right along with other "eyewitnesses".

Capt. Johnson of the Missouri State Highway Patrol should be retired - involuntarily. What a jerk! His job is as a cop. Even Gov. Nixon is cutting him out of the loop by not telling him that the National Guard was going to be sent in.

Johnson's "I'm so sorry" routine is appalling. Look again at the video of the strong-arm robbery. Now we know that Brown was 6'4", towering over the convenience store clerk.

Ofc. Wilson will find it hard to keep silent, but he must. You know the old saying (not so old) - "Anything you say can and will be used against you."

Brown's lawyers have already purchased the rope and are measuring it.

Yes, it's a sad time for the Brown family. But they need a dose of reality. Their son was a bully and a criminal. He wasn't shot because of the robbery. Whatever happened in the middle of that street is why he was shot.

The police in Ferguson had better figure out quickly who the outside instigators are and corral them. Clamp down and stop the rioting now, before it gets worse. Have Jesse Jackson and Al Sharpton already left town? Why aren't they in the crowds, calming them down? Maybe the news cameras have been pointed in a different direction.

They're already clearing out

The McHenry County Sheriff's Department has lost its Business Manager (but it gained a take-home car). As the countdown to December 1 continues, certain civilian employees must be dusting off their resumes and thinking about where they want to work next.

A few weeks ago I heard that Don Leist had left. Leist was the Equal Employment Opportunity (EEO) officer and Legal Affairs officer. Not "officer" in terms of deputy; he was a civilian employee and slid into the job when Nygren reworked the job description and threw in a requirement or preference for a law degree.

Republican candidate for sheriff Bill Prim had made it clear that he didn't intend to keep that position. It had been created for a particular reason following a Federal court order, and the position had outlasted its need well before Leist was hired into it. I think Nygren was angling to get a lawyer aboard who could fill his ear with more than just EEO business.

MCSD had a Business Manager and then gave her a take-home car, even though she lived outside McHenry County - a condition for having a take-home car, if you are a deputy. Why would the Department give a take-home car to a civilian employee whose only job was to fly a desk? Was she ever expected to respond in an emergency and rush to MCSD with the keys to the Coke machine?

I believe Prim had also said the Business Manager position was to be eliminated, and she must have seen the handwriting on the wall.

McHenry County will have a new sheriff on December 1, 2014. For the first time in a long time, the sheriff won't be part of the "machine". Whichever candidate is successful in the November 4th General Election, change will come to MCSD.

Riots in Ferguson, Mo.

I grew up in University City, Missouri, in the 1940s and 1950s. Ferguson is about six miles north of U. City. Closer than Crystal Lake is to Woodstock.

What happened a week ago there? Michael Brown allegedly conducted a strong-arm robbery in a Quik Trip convenience store, stealing some cigars. A 911 call was made at 11:51AM, and a Ferguson police officer arrived three minutes later.

Brown and his buddy, Dorian Johnson, were walking down the middle of a street, and at about 12:01PM Ferguson Police Officer Darren Wilson told them to get out of the street.

At that moment the officer didn't know that he was engaging a robber.

If Brown had had half a brain, he would have stepped out of the street to the sidewalk and gone on his way. But he knew he had just robbed a convenience store. Ofc. Wilson didn't know that.

The contact escalated, and Brown is dead. Why is yet to be determined and released.

Was Michael Brown a "gentle giant"? You know, a kid who had never been in trouble? A recent high school graduate? On his way to college? Mr. Clean, right?

Wrong. A bully and a robber. Was the Quik Trip his first foray into crime?

The Ferguson Police, St. Louis County prosecutor and others will get to the bottom of it. The Ferguson Police Department knows it is going to get sued. Trayvon Martin's family attorney miraculously has already appeared on the scene. Now, how did that happen?

The liberals started in early with words like "murder" and "execution". There will be more "eyewitnesses" than the population of Ferguson.

Publicity hounds Al Sharpton and Jesse Jackson showed up.

Missouri State Highway Patrol Capt. Ronald S. Johnson isn't helping matters, strolling with protestors and hugging them. Is that remaining impartial? He's a cop. His job is to enforce the law. Standing by while rioters loot a business is not his role. The City of Ferguson owes the shopkeepers for their losses.

The riots aren't over.

MCSD vs. FOIA - Round 2

On July 13 I filed a FOIA request by email with the McHenry County Sheriff's Department for the reports and other documentation of a call-for-service that related to a domestic disturbance involving a MCSD deputy.

When I didn't get the FOIA response within the statutory period, I filed a Request for Review with the Public Access Bureau of the Office of the Illinois Attorney General. They notified MCSD, and Cmdr. Cedergren was quick to reply, telling the Bureau that they never received my request.

Now, a little background. When Mrs. Weech was the FOIA office, she always responded promptly to my FOIA requests. I don't remember ever having to follow up to get a response.

Cmdr. Cedergren told the Bureau that my email contained a virus; however, that's not what the County's I.T. person had told him. The I.T. guy's communication was included, so I could read the exact wording.

It seems that my emailed request was quarantined because it "scored very high as a potential threat." According to the County's I.T. Email Filtering Overview (policy) "suspicious messages are deleted, or sent to a Quarantine where you have the option to review or deliver them to the user."

I can just imagine that my email was considered a "serious threat" because I was asking for information about a domestic disturbance involving a deputy. That deputy, some feel, should have been arrested and charged; others would have been. I.T. apparently did not exercise its option to deliver my FOIA request.

I re-submitted my FOIA request on August 12 and sent copies to Undersheriff Zinke, Cmdr. Cedergren and the County's I.T. Senior Network Engineer, asking one of them to be sure my email was delivered and requesting acknowledgement of its receipt.

When no acknowledgement was forthcoming, I telephoned the Records Department at 9:46AM on August 13 and learned that, indeed, my email had been received. So the clock is ticking for MCSD, and they now must responses by August 20.

Mrs. Weech did a terrific job as the civilian FOIA Officer of the MCSD. Now there are deputies in charge, and they are subject to orders of their superiors as well as under Illinois State Law. Which master will they serve?

Will Sgt. Decman tell Cmdr. Cedergren that the FOIA law is clear and that they must comply?

Will Cmdr. Cedergren tell Undersheriff Zinke that the FOIA law is clear and that they must comply?

When does it matter?

This came to me in an email this past week.

This is sobering. Thought provoking for sure. Unfortunately, there are a couple of people who block important messages out of their mind. Many of us will not live long enough to see the devastating results…but our grandchildren will!
How sad!!!!!

Looking back through the past 4 years, many “Whens" pop up. Read them all to better understand where we are going as a country.
WHEN - he refused to disclose who donated money to his election campaign, as other candidates had done, people said it didn’t matter.
WHEN -he received endorsements from people like Louis Farrakhan, Muramar Kaddafi and Hugo Chavez, people said it didn’t matter.
WHEN -it was pointed out that he was a total newcomer and had absolutely no experience at anything except community organizing, people said it didn't matter.
WHEN -he chose friends and acquaintances such as Bill Ayers and Bernadine Dohrn who were revolutionary radicals, people said it didn’t matter.
WHEN -his voting record in the Illinois Senate and in the U.S. Senate came into question, people said it didn’t matter.
WHEN -he refused to wear a flag lapel pin and did so only after a public outcry, people said it didn’t matter.
WHEN -people started treating him as a Messiah and children in schools were taught to sing his praises, people said it didn’t matter.
WHEN -he stood with his hands over his groin area for the playing of the National Anthem and Pledge of Allegiance, people said it didn't matter.
WHEN -he surrounded himself in the White House with advisors who were pro-gun control, pro-abortion, pro-homosexual marriage and wanting to curtail freedom of speech to silence the opposition, people said it didn't matter.
WHEN -he said he favors sex education in kindergarten, including homosexual indoctrination, people said it didn't matter.
WHEN -his personal background was either scrubbed or hidden and nothing could be found about him, people said it didn’t matter.
WHEN -the place of his birth was called into question, and he refused to produce a birth certificate, people said it didn’t matter.
WHEN -he had an association in Chicago with Tony Rezko- a man of questionable character and who is now in prison and had helped Obama to a sweet deal on the purchase of his home - people said it didn't matter.
WHEN -it became known that George Soros, a multi-billionaire Marxist, spent a ton of money to get him elected, people said it didn't matter.
WHEN -he started appointing White House Czars that were radicals, revolutionaries, and even avowed Marxist /Communists, people said it didn't matter.
WHEN - he stood before the Nation and told us that his intentions were to “fundamentally transform this Nation” into something else, people said it didn't matter.
WHEN - it became known that he had trained ACORN workers in Chicago and served as an attorney for ACORN, people said it didn't matter.
WHEN - he appointed cabinet members and several advisers who were tax cheats and socialists, people said it didn’t matter.
WHEN - he appointed a Science Czar, John Holdren, who believes in forced abortions, mass sterilizations and seizing babies from teen mothers, people said it didn't matter.
WHEN - he appointed Cass Sunstein as Regulatory Czar who believes in “Explicit Consent,” harvesting human organs without family consent and allowing animals to be represented in court, while banning all hunting, people said it didn't matter.
WHEN - he appointed Kevin Jennings, a homosexual and organizer of a group called Gay, Lesbian, Straight, Education Network as Safe school Czar and it became known that he had a history of bad advice to teenagers, people said it didn't matter.
WHEN - he appointed Mark Lloyd as Diversity Czar who believes in curtailing free speech, taking from one and giving to another to spread the wealth, who supports Hugo Chavez, people said it didn’t matter.
WHEN -Valerie Jarrett, an avowed Socialist, was selected as Obama’s Senior White House Advisor, people said it didn’t matter.
WHEN -Anita Dunn, White House Communications Director, said Mao Tse Tung was her favorite philosopher and the person she turned to  most for inspiration, people said it didn’t matter.
WHEN - he appointed Carol Browner, a well-known socialist as Global Warming Czar working on Cap and Trade as the nation's largest tax, people said it didn't matter.
WHEN - he appointed Van Jones, an ex-con and avowed Communist as Green Energy Czar, who since had to resign when this was made known, people said it didn't matter.
WHEN- Tom Daschle, Obama’s pick for Health and Human Services Secretary could not be confirmed because he was a tax cheat, people said it didn't matter.
WHEN - as President of the United States, he bowed to the King of Saudi Arabia, people said it didn't matter.
WHEN - he traveled around the world criticizing America and never once talking of her greatness, people said it didn’t matter.
WHEN - his actions concerning the Middle East seemed to support the Palestinians over Israel, our longtime ally, people said it didn't matter.
WHEN - he took American tax dollars to resettle thousands of Palestinians from Gaza to the United States, people said it didn’t matter.
WHEN - he upset the Europeans by removing plans for missile defense system against the Russians, people said it didn’t matter.
WHEN - he played politics in Afghanistan by not sending troops early-on when the Field Commanders said they were necessary to win, people said it didn't matter.
WHEN - he started spending us into a debt that was so big we could not pay it off, people said it didn't matter.
WHEN - he took a huge spending bill under the guise of stimulus and used it to pay off organizations, unions, and individuals that got him elected, people said it didn't matter.
WHEN - he took over insurance companies, car companies, banks, etc., people said it didn’t matter.
WHEN - he took away student loans from the banks and put it through the government, people said it didn't matter.
WHEN - he designed plans to take over the health care system and put it under government control, people said it didn’t matter.
WHEN - he claimed he was a Christian during the election and tapes were later made public that showed Obama speaking to a Muslim group and ‘stating’ that he was raised a Muslim, was educated as a Muslim, and is still a Muslim, people said it didn’t matter.
WHEN -he set into motion a plan to take over the control of all energy in the United States through Cap and Trade, people said it didn't matter.
WHEN – he traded 5 terrorists in Gitmo for 1 deserter/“possible” traitor without consulting Congress, people said it didn’t matter.
WHEN-he finally completed his transformation of America into a Socialist State, people woke up— but it was too late. Add these up one by one and you get a score that points to the fact that Barrack Hussein Obama is determined to turn America into a Marxist-Socialist society. All of the items in the preceding paragraphs have been put into place. All can be documented very easily. Before you disavow this do an Internet search. The last paragraph alone is not yet cast in stone. You and I will write that paragraph. Will it read as above or will it be a happier ending for most of America?
Don’t just belittle the opposition. Search for the truth. We all need to pull together or watch the demise of a free democratic society. we need to seek the truth and take action for it will keep us FREE. Our biggest enemy is not China, Russia, North Korea or Iran. Our biggest enemy is our complacent selves. The government will not help, so we need to do it ourselves.
