Judge Meyer blows away smoke in FEN case

If you are following the forever case of FirstElectricNewspaper (FEN) against the McHenry County Sheriff's Department, you'll want to read what happened in court yesterday.

The latest "show" was an effort by the Sheriff's attorneys, now the McHenry County State's Attorney Office, when they tried to buy some more time. FEN's attorney, Mary Gardner, objected, and rightly so.

Publisher Pete Gonigam's Freedom of Information Act request is not for political purposes. He has said that, and I agree. But it's clear from the Sheriff's point-of-view that he (the sheriff) doesn't want Leist's report into Zinke's error out where the public can read it before the March 18th Primary Election. They are stalling, stalling, stalling.

What's the immediate timetable now?

Assistant State's Attorney Brandy Quance has a week to file her next Motion.
Attorney Gardner has a week to respond.

Arguments... you betcha. Wouldn't it be nice if Judge Meyer cried "Uncle!" and ordered the Sheriff to turn over Don Leist's 100-page "investigation" of the gaffe by Andy Zinke, when he spilled the beans to Brian Goode about a confidential DEA investigation involving illegal drugs headed to RITA Corporation in Crystal Lake?

McHenry County State's Attorney Lou Bianchi handed out a prepared statement in Rockford after Special Prosecutor Thomas McQueen was found Not Guilty by Judge Joseph McGraw.

"The McHenry County State’s Attorney’s office understands its role to insure that that everyone is treated equally, impartially and equitably. Each and every Assistant State’s is committed to DO JUSTICE: making sure that the system if [sic] fair to all, always doing the Right Thing, at the Right Time, for the Right Reasons."

The Right Thing is for the sheriff's attorney to tell him he doesn't have a leg to stand on and to comply with the decision of the Illinois Attorney General's Public Access Counselor to give the report to FEN.

Will Nygren refuse to comply, even if Judge Meyer orders it? What happens then?
