Is Keith Nygren really ineligible for re-election as Sheriff of McHenry County?

Nygren and his wife bought an expensive home in Cape Coral, Florida in September 2006. They signed mortgage papers at Home State Bank (Crystal Lake, Ill.) and affirmed that the home would be used as a "second home".
Less than three months later Mrs. Nygren applied for the Florida Homestead Exemption. To receive the homestead exemption, the property must the primary residence. You can't claim a homestead exemption in two states. She agreed to revoke the Illinois homestead exemption.
The Nygrens conveniently forgot a "minor" detail of abandoning the Illinois Homestead Exemption, until it came to light earlier this year. Then Keith hurried over to the McHenry County Assessor's Office and a carefully crafted letter was dispatched to Florida officials.
By claiming the Florida homestead exemption, did Nygren himself become a de facto Florida resident and thereby lose his eligibility to run for office in McHenry County?
A complaint has been delivered to the office of McHenry County Clerk Katherine Schultz, asking her to remove Nygren from the November 2, 2010 General Election ballot.
The facts are in plain view. An investigation should take about 15 minutes. A decision could be made by 5:00PM today.
