Record time in court?

The Daily Herald carries a story this morning about Sgt. Matthew Hicks, 46, of the Des Plaines Police Department. Hicks, a Huntley resident, was accused last April of beating on his wife, and Judge Gordon Graham dismissed charges on December 21, when a police officer witness failed to appear for the trial.

Let me be polite here and just say, "What the heck?"

First, whoever heard of a trial happening in McHenry County within eight months of charges being filed? Isn't a case supposed to drag out for 2-3 years?

But, more importantly, where was the Huntley police officer, when he was supposed to be in court on December 21?

According to court records, Judge Graham allowed two continuances (May 5 and June 9) on motions by the defense. Hicks was represented by counsel from Botto Gilbert Schottland & Anderle.

Judge Graham allowed a continuance on November 18 on Motion by the State's Attorney. At that time, did the State's Attorney give notice to the Huntley officer that he would be needed in court on December 21? So, where was he on December 21? On vacation? Out sick? Working? Christmas shopping?

Sgt. Hicks is to face the Des Plaines Police and Fire Commission on January 10-11. I'll bet he was happy to have his case tossed by Judge Graham.

I'll also bet he wasn't too happy to learn that the McHenry County State's Attorney has re-filed charges. Hicks' next date in McHenry County court, this one on Case No. 10CM002934, is January 18, 9:00AM. Same courtroom (303); same judge.
