The Chicago Tribune is reporting on Illinois Attorney General Lisa Madigan's last-ditch effort to trash the General Assembly's passage last Friday of HB 0183.
The Tribune reports that Gov. Quinn has 60 days to sign that bill into law; otherwise, it becomes law. But sixty days from May 31 won't meet the Circuit Court of Appeals order.
When I called the Gov's office yesterday, a woman there told me he has "6 days" to sign it. I wonder if the deception was intentional. Did she mean from June 3 to June 9 (or June 8). Just when does the Court's "180 days" run out?
The U.S. 7th Circuit Court of Appeals ruled on December 11 that Illinois' law prohibiting concealed carry of a loaded firearm was unconstitutional. Then it relapsed into bad thinking and gave Illinois lawmakers 180 days to come up with a law.
OK, so as of last Friday, May 31, Illinois legislators passed a bill. It's not a "law" until Gov. Quinn signs it. If Lisa Madigan want to play the "court" game, then as of June 8 (or June 9?), there is no law in Illinois that prohibits concealed carry, because the current law is unconstitutional.
Will law-abiding citizens who hold a FOID card start carrying loaded concealed firearms on Monday, June 10?
Current law allows the holder of a FOID card to carry ("transport") an unloaded firearm " ... enclosed in a case, firearm carrying box, shipping box, or other container..." There is no definition of "other container"; many think there is no reason that an "other container" could not be a fanny pack, briefcase, sandwich bag, lunch box or anything else that could "contain" the firearm. Maybe even a holster, although some think that's pushing it.

This is outrageous, im no lawyer but I thought the courts decision stands until it is overturned even if they give them more time to sign it. So tired of the politicians doing everything they can to try and delay this....
