Accident Investigation - Stalled?

On October 26, 2007, an accident occurred on Haligus Road that involved two fatalities and two serious injuries.

In five months the McHenry County Sheriff's Department has not been able to decide on any traffic charges. Not any. Not even one. What's going on?

In response to my March 3rd FOIA request, the sheriff's department sent only a copy of the preliminary accident report. Although I had requested toxicology test results and information about any ticket(s) issued, the sheriff's department failed to comply with that portion of the FOIA Request.

In December the sheriff's department had advised that toxicology results were delayed because the Illinois State Police Crime Lab was 90 days behind. Ninety days would put delivery of the test results out to about the end of January. That came and went. The end of February came and went.

On March 25 I called Sgt. Hubbard again for an update. She did not even have the courtesy to return the call; she also did not return calls on February 14 and February 29.

In a conversation with the Press Information Officer of the Illinois State Police, I learned that the Crime Lab is still running about 90 days behind. I could not learn the date when they received the specimens to be tested or the date when they delivered the results to the sheriff's department, but it surely seemed to me that the sheriff's department has got the results. And my guess is that they have had them for about two months.

What are they waiting for? Were the tests positive? Are they going to the Grand Jury for charges?

What's really going on here? Basic charges for the accident should have been filed within a week of the accident. All reports indicate the driver ran off the road, causing the accident. Charges can always be upgraded, when new information (testing results) so indicates.

Why is the McHenry County Sheriff's Department sitting on this one?

Alright Frank! You seriously need to shut the fuck up about this! I am tired of you peering your hideous bald head into where it doesn't belong. They just got off of school so how could they be under the influence of anything? The driver lost a friend and a sibling and here you are worried if any charges were filed. How do you think the driver is going to live with this the rest of their life? What does this have to do with you in any way? Trying to act like a big man solving the case? Go find some tinted windows or shopping carts in a parking lot to bitch about and leave this alone. You need the crap kicked out of you and maybe you will get a clue!

The above posting shows an unawareness of reality. Time of day or prior presence in a classroom has nothing to do with whether one could be under the influence of "anything". The reference, of course, is to being under the influence of a substance (or condition) that would impair driving ability.

I think we all hope there was no such impairment. The results from the Illinois State Police Crime Lab in Rockford may put to rest any suspicion of such influence.

However, no matter how difficult the impact is on the driver or family or survivors or friends, the sheriff's department has a responsibility to file the appropriate traffic charges. They should have done so promptly; i.e., within days of the accident.

Why isn't Sheriff Nygren directing the deputy who investigated the accident or the responsible supervisor to file those charges?

Yes Frank, the sheriff's department has a responsibility to file the appropriate charges, NOT YOU!!!!! Let them do their job and stop peering into something that you have no business interfering with. If charges were going to be filed they would have been made already. I can tell you now that there is no impairment.
Do you know why no one will return your calls? YOU ARE A PAIN IN THE ASS!!! Nobody wants to deal with you because trash everyone.

How can anyone read on if they have to read this babbled bullshit? Around 95% of posts on this stupid site are negative and demeaning to the town. You always have to find fault with everything in this town, neighboring town/cities, and the country. These posts are never written with correct and full information. They are quickly spewed out with no knowledge of the issue. And when you say you will post further info, it never appears. I'm still waiting for you to find that vehicle code for traffic stops. What gives? You can't find something that doesn't exist.
